Welcome to Symbol XO. These Terms and Conditions ("Terms") govern your access to and use of the Symbol XO application, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use Symbol XO.

1. About Symbol XO

Symbol XO is a social dating platform that connects people through curated in-person events. Users can browse and attend events, complete compatibility questionnaires, and discover mutual matches with other attendees. The Service is operated by Symbol XO ("we," "us," or "our").

2. Eligibility

You must be at least 18 years old to use Symbol XO. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Registration

To use Symbol XO, you must create an account using a valid phone number. You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date. You are solely responsible for all activity that occurs under your account.

4. User Conduct

You agree that you will not:

  • Harass, abuse, threaten, stalk, or intimidate other users

  • Impersonate any person or entity, or misrepresent your identity or affiliation

  • Post or transmit content that is false, misleading, defamatory, obscene, or otherwise objectionable

  • Use the Service for any unlawful purpose or in violation of any applicable law

  • Attempt to gain unauthorized access to the Service, other accounts, or any related systems

  • Use automated means (bots, scrapers, etc.) to access or interact with the Service

  • Solicit other users for commercial purposes or spam

We reserve the right to suspend or terminate any account that violates these Terms or engages in behavior that is harmful to other users or the integrity of the platform, at our sole discretion.

5. Events and Matching

Symbol XO facilitates event discovery and attendance through third-party event platforms. We do not guarantee the availability, accuracy, or safety of any event listed on the Service. Attendance at events is at your own risk.

The matching feature is based on questionnaire responses and mutual selections. Matches are not guaranteed, and Symbol XO makes no representations about the compatibility, intentions, or conduct of other users.

6. User Content

You retain ownership of any content you submit to Symbol XO, including photos, profile information, and questionnaire responses ("User Content"). By submitting User Content, you grant Symbol XO a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content. You represent that you have all necessary rights to submit it and that it does not violate any third party's rights.

7. SMS and Text Messaging

Symbol XO uses SMS text messaging as part of the Service, including for account authentication, event notifications, match alerts, and important service updates (the "Symbol XO SMS Notifications" program).

Consent

By providing your phone number and creating an account, you expressly consent to receive recurring automated text messages from Symbol XO at the phone number you provided. Consent is not a condition of purchase. You may still use the Service where alternative authentication methods are available.

Message Frequency

Message frequency varies based on your activity. You will receive an authentication message each time you log in. Event and match notifications are sent as relevant activity occurs. You can expect to receive approximately 2–10 messages per month depending on your usage.

Message and Data Rates

Message and data rates may apply. Symbol XO does not charge for SMS messages, but your mobile carrier's standard messaging and data rates may apply. Contact your carrier for details about your plan.

Opt-Out

You can opt out of receiving text messages at any time:

  • Text STOP to any message you receive from us to unsubscribe from all future SMS messages.

  • After sending STOP, you will receive a one-time confirmation message. No further messages will be sent unless you re-opt in.

Please note that opting out of SMS may affect your ability to log in, as Symbol XO uses phone-based authentication.

8. Privacy

Your privacy is important to us. Our collection, use, and sharing of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in the Privacy Policy.

9. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Symbol XO. The Service is protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

10. Third-Party Services

Symbol XO may integrate with or link to third-party services, including event platforms, payment processors, and authentication providers. We are not responsible for the content, terms, or practices of any third-party service. Your use of third-party services is at your own risk and subject to their respective terms.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Symbol XO does not conduct background checks on users. You are solely responsible for your interactions with other users. We encourage you to exercise caution and good judgment when meeting anyone through the Service.

12. Limitation of Liability

To the maximum extent permitted by law, Symbol XO and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service, your interactions with other users, or your attendance at any events discovered through the Service.

13. Indemnification

You agree to indemnify and hold harmless Symbol XO and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any third party's rights.

14. Account Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other reasonable means. Your continued use of Symbol XO after changes are posted constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.
